Terms of Service
These terms cover your use of MackOps, operated by Makacek Media, Toronto, Ontario, Canada. By creating an account or using MackOps, you agree to them. If you use MackOps for a business, you agree on behalf of that business.
1. Early access
MackOps is in early access. Features may change, and some are marked as coming soon. We'll tell you before removing anything you rely on.
2. Your account
Keep your sign-in secure and give access only to people on your team. You're responsible for what happens under your account and for the roles you give your team.
3. Your content
You own everything you put into MackOps: jobs, media, captions, client details and the rest. You give us permission to store, process and display it, and to publish it to the accounts you connect, only as needed to run the service for you. You confirm you have the rights to the content you publish and the consent needed to message your clients.
4. Connected platforms
When you publish through MackOps you're still bound by each platform's own rules, including the Meta, TikTok, YouTube, LinkedIn and Google terms. If a platform changes or limits its API, some publishing features may change or stop. We're not responsible for a platform's decisions about your account or content.
If you use MackOps to publish to YouTube, you agree to be bound by the YouTube Terms of Service.
5. Acceptable use
Don't use MackOps to send spam, publish unlawful or infringing content, harass anyone, get around platform limits, or break or probe the service. We may suspend accounts that do.
6. Fees
MackOps is a monthly subscription. Early access plans start from $100 per month for trade crews and $250 per month for agencies, in US dollars, plus applicable taxes. Your exact price depends on your plan and team size. We'll confirm it with you before you're charged, and you can cancel before your next billing date.
7. Availability and warranty
We work to keep MackOps running and your data safe, but the service is provided “as is”, without warranties of any kind, to the extent the law allows.
8. Liability
To the extent the law allows, we aren't liable for indirect or consequential losses, lost profits or lost data, and our total liability is limited to the amount you paid us in the 12 months before the claim, or CAD $100 if you paid nothing.
9. Ending your use
You can stop using MackOps and close your account at any time. We may suspend or end access for a breach of these terms. After closing, you can ask us to export your data within 30 days, then it's deleted as described in the Privacy Policy.
10. Law
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Disputes go to the courts in Toronto, Ontario.
11. Changes and contact
If we change these terms in a meaningful way, we'll give account holders notice by email before it takes effect. Questions: tomas@makacekmedia.com.
